Welcome to PitoReel. These Terms of Service ("Terms") govern your access to and use of the PitoReel platform, website (pitoreel.com), mobile applications, and all related services (collectively, the "Service") operated by PitoReel ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years of age to use PitoReel. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the Service, you represent and warrant that you meet these eligibility requirements.
If we learn that we have collected personal information from a child under 13 without parental consent, we will take steps to delete that information promptly. If you believe a child under 13 has provided us with personal information, please contact us at support@pitoreel.com.

You may not create an account using false or misleading information, or on behalf of someone other than yourself without their permission. We reserve the right to suspend or terminate accounts that violate these requirements.
PitoReel is a curated streaming platform built for independent and regional storytelling. The Service provides access to video content, creator channels, live streaming, and related features through paid subscription plans. The availability of content may vary by region and is subject to change without notice.
PitoReel consists of two distinct offerings:
PitoReel offers multiple subscription tiers with varying features and pricing. Current plans and pricing are displayed at the time of purchase. We reserve the right to modify subscription plans and pricing with at least 30 days advance notice.
We may offer free trial periods. At the end of a free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial period ends. You will not be charged during the trial period.
You may cancel your subscription at any time. Upon cancellation, you will retain access to the Service until the end of your current billing period. We generally do not provide refunds for partial billing periods, except as required by applicable law.
All content available through PitoReel, including but not limited to movies, series, images, graphics, logos, trademarks, audio, video, text, and software, is owned by or licensed to PitoReel and is protected by copyright, trademark, and other intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and view content for personal, non-commercial use only. You may not:
Creators who upload content to PitoReel retain ownership of their original work. By uploading content, creators grant PitoReel a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the Service and PitoReel's business, including for promotional purposes.

All creator content is subject to review by PitoReel before publication. We reserve the right to reject, remove, or suspend any content at our sole discretion, with or without notice, for any reason including violation of these Terms or our Community Guidelines.
PitoReel respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to notices of alleged copyright infringement that comply with applicable law.
If you believe that content on PitoReel infringes your copyright, please send a written notice to our designated agent containing:

You agree to indemnify, defend, and hold harmless PitoReel, its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PITOREEL, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Before filing any formal dispute, you agree to first contact us at support@pitoreel.com and attempt to resolve the dispute informally for at least 30 days.
If we cannot resolve a dispute informally, you and PitoReel agree to resolve any claims relating to these Terms or the Service through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in the English language in the State of New Jersey, or at another mutually agreed location.
YOU AND PITOREEL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in court for matters related to intellectual property rights or unauthorized access to the Service.
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. To the extent that arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts located in New Jersey.
The Service may contain links to third-party websites, services, or content that are not owned or controlled by PitoReel. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that PitoReel shall not be responsible or liable for any damage or loss caused by your use of any such third-party content or services.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Service.
PitoReel shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics, pandemics, internet or telecommunications failures, power outages, or cyberattacks.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and PitoReel regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
