PitoReel Creator Portal Terms of Use
By applying to the PitoReel Creator Program, you agree to the following:
1. Eligibility & Account Access
The Creator Portal is available only to approved creators who are 18+ years of age. Your credentials are personal and non-transferable. You are responsible for all activity under your account.
2. Content Ownership & License
You retain full ownership of all content you upload. By uploading, you grant PitoReel a non-exclusive, worldwide, royalty-bearing license to host, stream, distribute, display, and promote your content on all PitoReel platforms (web, mobile, Roku, future platforms) for the duration of your agreement.
3. Content Standards
No hate speech, harassment, sexually explicit material, copyright-infringing content, misleading metadata, or content violating any law. All music must be original, licensed, or royalty-free. PitoReel may remove violations without notice.
4. Revenue & Payments
Revenue is calculated based on minutes watched by subscribers. Payouts are monthly via your payment method on file (minimum $50 threshold). Tax reporting is your responsibility. Revenue may be withheld pending investigation of violations.
5. Analytics & Data
The Portal provides performance analytics (views, watch time, demographics, revenue). Analytics data is proprietary to PitoReel. You may use it for personal business purposes but may not publicly disclose platform-wide statistics.
6. Content Removal & Takedown
You may remove your content at any time (processed within 48 hours). PitoReel may remove content upon receiving a valid DMCA request, court order, or Terms violation without notice.
7. Three Strikes Policy
First violation: warning + content removed. Second violation: content removed + 14-day upload suspension. Third violation: permanent account termination. Outstanding revenue paid if no fraud involved.
8. Confidentiality
Internal analytics, platform metrics, unreleased features, and business communications shared through the Portal are confidential. You agree not to disclose to third parties without written consent.
9. Platform Changes
PitoReel may update the Portal, features, revenue models, or these Terms at any time. Material changes communicated 14 days prior. Continued use constitutes acceptance.
10. Termination
You may terminate your account at any time via support@pitoreel.com. Content removed within 30 days. Earned unpaid revenue paid in next cycle. PitoReel may terminate for breach, 12+ months inactivity, or with 30 days notice.
11. Limitation of Liability
PitoReel is not liable for loss of revenue, data, or exposure from downtime, bugs, or interruptions. Total liability shall not exceed revenue paid to you in the preceding 12 months.
12. Indemnification
You agree to indemnify PitoReel from claims arising from content that infringes third-party rights, breach of these Terms, or misrepresentation of ownership.
13. Governing Law & Disputes
Governed by the laws of Arkansas. Disputes resolved through binding arbitration in Pulaski County, AR. Class action waiver applies.
